Supreme Court dismissing request by the attorney of 15 trafficking survivors from Cambodia to have the case tried by Criminal Court’s Trafficking in Persons Division

The attorney of the 15 trafficking survivors, a co-plaintiff in this case, has pleaded to the Provincial Court of Ranong to have the case transferred to and tried by the Criminal Court’s Trafficking in Persons Division. Later the Provincial Court of Ranong has accepted the request and passed it on to the Supreme Court to review per Article 26 of the Criminal Procedure Code  (for more information, please seehttp://hrdfoundation.org/?p=1561 and  https://www.facebook.com/permalink.php?story_fbid=1235201889847970&id=175177715850398 )

On 17 August 2016, the Provincial Court of Ranong read the verdict of the Supreme Court concerning the request. The Supreme Court deemed that it was not sufficient per the motion filed by the attorney and co-plaintiff in this case to convince the Court that there had been attempts to obstruct the justice or there would be any unrest or other dangerous incidence which might affect the material interest of the state as prescribed for in Article 26 of the Criminal Procedure Code. Therefore, the Supreme Court dismissed the request to have the case transferred from the Provincial Court of Ranong and to be tried by the Criminal Court’s Trafficking in Persons Division and the order is final.

Therefore, the Provincial Court of Ranong shall proceed the hearing of plaintiff and co-plaintiff witness examination for black case number KM.1, 3/2559 on 13-14 September 2016, for black case number KM.2, 4/2559 on 18-20, 24-26, 31 January 2017 and 1-3 February 2017.
